Don’t Let Debt Defeat You: Chapter 7 Bankruptcy Can Provide a Fresh Start

If you’re plagued by debt, filing chapter 7 bankruptcy may be the most effective way to protect yourself from creditor harassment and start afresh.

What is a chapter 7 bankruptcy?  A chapter 7, or liquidation bankruptcy, means that your “estate” – i.e., your assets – is sold in order to pay off your creditors.  A reorganization bankruptcy can also involve the selling of assets, but more often than not you can retain a majority of your assets while your creditors’ needs are assessed.  A chapter 7 bankruptcy case does not involve the filing of a plan of repayment as in chapter 13.  Instead, the bankruptcy trustee gathers and sells the debtor’s nonexempt assets and uses the proceeds of such assets to pay holders of claims (creditors) in accordance with the provisions of the Bankruptcy Code.  Part of the debtor’s property may be subject to liens and mortgages that pledge the property to other creditors. In addition, the Bankruptcy Code will allow the debtor to keep certain “exempt” property; but a trustee will liquidate the debtor’s remaining assets.
